BIRDIE.lv, SIA KRIPEX, Reģ. Nr. 40203666784, Akmens iela 2–9, Cēsis, Cēsu nov., LV-4101, hereinafter – Internetveikals, provides the content available on the website and supplies goods/services in accordance with the Terms of Use set out below.
1. General terms
If a consumer purchases goods/services through the website, such an agreement is considered a distance contract and is subject to the laws of the Republic of Latvia, including the Consumer Rights Protection Law, Cabinet Regulations “Regulations on Distance Contracts” and others.
2. Making purchases
- The prices and specifications of products sold in the online store are listed next to the products.
- To place an order, the buyer adds products to the cart, fills in the required details and chooses a delivery method.
- The order total including delivery is shown before payment.
- Product images may differ slightly from actual appearance.
3. Payment terms
The site's settlement currency is the euro. Payment options provided by MakeCommerce.lv and Maksekeskus AS:
- Latvian online bank payments: Swedbank, SEB, Citadele, Luminor
- Estonian online bank payments: Swedbank, SEB, Luminor
- Lithuanian online bank payments: Swedbank, SEB, Luminor
- Finnish online bank payments: Aktia, Ålandsbanken, Danske, Handelsbanken, Nordea, Oma Säästopankki, Pohjola, POP Pankki, S-Pankki, Säästopankki Visa/Mastercard card payments
Personal data required for payments is transferred to the licensed payment institution Maksekeskus AS. The contract enters into force after successful payment confirmation. If the order cannot be fulfilled, the Buyer will be informed and the paid amount refunded within 14 days.
4. Delivery terms
- Goods are delivered to the following countries: Latvia.
- Delivery methods:
- Omniva parcel lockers,
- Venipak parcel lockers,
- Unisend parcel lockers,
- on-site pickup of goods.
- Delivery time: 2–6 business days. In exceptional cases – up to 45 calendar days, with the customer informed.
5. Right of withdrawal
- The buyer has the right to withdraw from the purchase within 14 calendar days (except legal entities and personalized goods).
- To exercise the right of withdrawal, the buyer submits a withdrawal request in writing to info@birdie.lv. Each case is reviewed individually.
- Return costs are covered by the buyer, unless the item doesn't match the order.
Refunds are made within 14 days of receiving the returned goods.
Conditions for returned goods:
The online store does not accept returns if:
- It is damaged due to the buyer's fault.
- It is used contrary to its intended purpose or used intensively.
- No saved items usage characteristics (e.g., functionality, safety).
- Products appearance has changed significantly (e.g., scratches, dirt, etc.) that affect its value.
⚠️ Original packaging is not considered significant for exercising the right of withdrawal.
6. Consumer rights regarding non-conforming goods
Liability period:
- The online store is liable for non-conformity of goods for 14 days after receipt. This applies to all goods, including disc golf equipment and other sports gear.
Buyer's obligation:
- If the goods do not conform to the contract (e.g., damaged, missing parts or not as described), the buyer must inform the online store within 14 days of discovering the non-conformity by sending a message to info@birdie.lv. The message must state the order number, product name and a description of the non-conformity.
Resolution options:
After receiving the notification, the online store provides one of the following solutions:
- Product exchange for an equivalent product;
- Naudas atmaksa within 15 days of receiving the notification.
Additional information
- The buyer has the right to receive goods in proper condition in accordance with the Consumer Rights Protection Law of the Republic of Latvia and other applicable regulations.
7. Processing of the buyer's personal data
Processes only the personal data the buyer provides to place an order (name, surname, email, etc.).
Data is shared with transport service providers for the delivery of goods. If the buyer has consented to marketing communication, they may opt out by writing to info@birdie.lv.
8. Dispute resolution
Disputes are resolved through mutual negotiation or written correspondence. If that fails, disputes are settled in the courts of the Republic of Latvia or at the Consumer Rights Protection Centre. The buyer may also turn to EU dispute resolution bodies.
